PvE gear is more useful in PvE (for most classes). If one player is wearing PvE gear and another is wearing PvP gear that is of equal level, that doesn't mean the PvP player will win.
I do dailies on the isle, flagged for pvp, in dps pve gear and get jumped by pvp toons all the time. Sometimes I win, sometimes I don't. It just depends on what class you're playing against.

People that PvP get gear that is good for PvPing. People that PvE get gear that is good for PvEing. Please point out the fail?

Wrong, people who play PvP get gear that is mediocre in PvE, and likewise people who participate in PvE get mediocre gear for PvP.
PvP gear might be viable in (early) raids because they have a good amount of DPS / healing stats, but will always be sub-par compared to pure PvE gear as they have less or no item budget spent on survivability. Turned around, PvE gear can be quite fun in battleground and world PvP, but lack the survivability stats needed to last longer than a few seconds in direct combat.
TBH, I don't see the problem here.
I don't think I'm wrong. Fury warriors in PvP gear can perform equally as well as a fully PvE geared fury warrior. You may say they can't, but I've seen that they can. I've tested it as well.

I have an idea that might work for ya. Unless you are in a BG/Arena/Duel, your pvp gear reverts to just greys. Wait, that doesnt work, because your now gimped even if you attempt to kill a critter. How bout tier gear(not just epics from an instance but actual T4/5/6 peices) convert to the equivalent pvp gear when in a duel/bg/arena. No no, that doesnt work. At this point, the pvp/pve game is far too unbalanced.
Blizz tried smashing pvp into the game before the game was ready imo. I play on a pvp server. I have a lock in t4/5 gear and I havent done dailies in almost 2 months. Simply because i get 3 shotted every 5 seconds and end up running back to my body more than i complete quests.
The easy answer is just transfer to a pve server. No one can bother you there. Otherwise, just suck it up and hope like i do that blizz will fix the issues that glad gear present.
A better balance between gear that takes a week to get, and gear that takes more than a month. Now pvpers dont start with "OMG! Pvp gears is hurd to getz on mah servers!". Its a joke.Grind bgs for a week, and have a wep and 3 other peices. Go grind an instance for 4 months hoping for a drop. Badges have come to the rescue for some, but they dont save your ass when that s4 rogue opens up and smears you around the landscape.
In my mind, BG gear should stay blue/rare quality. Its good, but not epic. Arena gear should be epic, but have reqs like they do now. This way, pve players wont scream that pvp gets easy gear, and when you go bg, your not jumping from greens to t8ish gear. I know this isnt perfect, but seems to make a decent balance. Anyone else have thoughts?
