1) Yes you can. Doesn't violate them at all, but you might be able to find other web hosts out there that specialize in guild webpages which can include calendars. Speaking of which, Facebook might even be a good fit.
2) Yesno. I would suggest not making it on a RP server. People on a RP server could potentially petition Blizzard to force a name change because it's referencing a RL work, even though it's fantasy. You would be justified in doing this on a RP server, but I think Blizzard just does whatever whiners ask for just to make them shut up.
If you can, make the name based on an element of HP, but without the actual HP name. Example, Order of the Phoenix sounds nice and fantasy-esque... the problem being, there are 125 guilds already with that name... so you may have to get creative.
3) Ultimately, the people you will attract with this are really young people and adults. You'll be ridiculed by teenagers, because it's their job to look down on stuff like this... remember, they know more than you do... about everything.
What it comes down to is if you are a successful guild, where everyone has fun, and can actually do some PvE advancement, or PvP success, you'll get people to join, regardless of the name. People just want to have fun in a non-drama environment. At that point, your name won't matter, but you definitely start with an uphill climb.

thank you for all the input. I selected a name "The Dueling Order" so that it could go both ways. (Wow or HP) and was considering the ranks to be perhaps those found at the ministry or the school. So do you think this sort of theme should be in a RP realm still?
What's the best makes of a guild that you have experienced?

Something like that might make people think that you're a pvp-centric or duelling guild. Even if you're not, you'll spend all your time explaining yourself.
It's not so much what makes guilds good, as what makes them fail. Normal adults can generally get along, but things that make guilds fail is almost always related to 1) gear. 2) helping people in low-end content where you'd rather not go.
Make the loot rules fair. Be flexible on your raid rules (you say show up at 5, when a regular doesn't and you invite someone to take their spot, they will yell, and very likely gquit. Doesn't mean you did anything wrong, but it just works out that way).
Beyond that there isn't much else.

2.) Does it go against WOW terms to create a guild based on Harry Potter?
This goes against human decency. However it is in fact in the ToU under naming conventions that you can not name your characters after real people or existing characters of fiction.
