It seemed that you were saying that the only purpose of the court system is to try people in cases, and that you were saying the supreme court should not change law, which they are supposed to do.
However, you are right, making opinion of the judges into law is not the job of the court, however, it is ludicrous to assume that the opinion of the judges is not part of the process, because the entire process is a matter of what does the judge think the right decision is based on the constitution, and any interpretation by anyone causes opinion and personal bias to be factored in, so no, it is not their job, but because they are people, it definitely has an influence on them. Also, activist judges are not completely bad or completely good, because they are simply people who believe that the current system is not supported by the constitution and believe that this should be changed. They are not 'making random opinion into law' they are just making their opinion about what the constitution says into law, which is exactly what the purpose of the supreme court is, except stating it in a more realistic manner, because, as I stated earlier, any person interpreting the constitution is really stating their opinion on what it says. All judges are activist judges in some way or another, just some are labeled as such because they believe the constitution says that the current laws are wrong, and vote accordingly, instead of believing that the constitution says the current laws are right, and voting according to that belief.
That is why the system of checks and balances allows the legislative branch to write the laws to say specifically how the judges are to rule, and the juries are another place where the law is put into the hands of the people. It is true that the system is supposed to change, but it is designed to do this a certain way: through amendments.
Executive: Enforce the system.
Judicial: Weigh the lawfulness of the system and its citizens
Legislature: Writes the laws and changes the system.
An activist judge shouldn't be a judge, but instead a senator. In order to get there, they would need to convince the electorate of thier agenda. To change the system without being elected is to enforce your own will, not that of the people. Democracy lost.

mytie, the problem with your analogy is that food is necessary for life, education just makes life better, and when a family with very little money has to decide whether or not to send their child to school, even now they often decide against it, imagine what would happen if they weren't given it for free?
Also, while overall school costs less than food, private schools cost way too much money for the average person to afford, so making the economy provide education would just cause most people to be uneducated and would be disastrous to our economy.
Why do they cost more? Because they have to charge more because parents send thier kids to the free one more often than not.. even if the free one teaches nothing but violence and cheating.

I don't even think that comment was well thought out. I attended public schools for my entire school "career" and I wasn't
taught
about violence and cheating. I never cheated in my life.
They charge more because it is a totally different environment than a public school. Most of the time private schools are related to a religion, ie Catholic school. They can then teach things that wouldn't be taught in a public school because they don't have to follow any rules. They parents pay more for private schools because their children are getting a more specialized education than they would recieve in a public school.
I know you home school your children, and based on that statement that you made it seems that you have a strong opinion on public schools. You are entitled to your opinion, but that doesn't mean it's fact. Not all public schools are garbage. Some, yes, but not all as you alluded to.
Ugh.... The system is a crap chute. Don't argue on its behalf due to the rare case that a good school exists.

For misrepresenting me, you should have to actually give a good representation of my views on public education, to my satisfaction. This is to just prove that you know better than to accuse me of stereotyping.

I am not free from stereotypes, admittantly. I am not a perfect human. However, I am extremely careful in my wording, so that I can debate effectively.
Finally, you made some claims you failed to back up with quotes:

Wow.... you got me there. Allow me to say I'm sorry. I'm definately not thinking clearly. Allow me to restate what I mean:
When reading my writing, you would be hard pressed to find a case of me stereotyping anything. If you would like to challenge me and accuse me of stereotyping, it is advised to ensure you have your facts straight before you do. This is not to say that I am perfect. I have made the mistake of stereotyping before.
Anyway, Zaputo... when I use the word 'one' in order to distinguish something from the rest of things like them, such as: 'one school', I don't understand how that could be mistaken as a "blanket statement" I made on schools. In fact, the word 'one' was used twice in the first post to ensure that it wouldn't be mistaken as a blanket statement.
Of course, if all else fails, you can always misquote me.
I think, though, in this particular arguement, I'm just going to let you win for expediency's sake. I don't care to defend my reputation against you. You win. Have a nice day.

You would be a happier person if your world did not revolve around who did or did not 'win'. This polarization that you live in on a daily basis is the most repelling personality characteristic you possess.
