You mean Heroic mode? You get that when you down The Lich King in normal mode.

No I mean hard modes, such as in Ulduar...
Ulduar was the first attempt at introducing HardMode encounters. Well, I guess Sarth was with the option of leaving Drakes alive.
Ulduar's HardMode model was that you had to do something special in the normal instance (kill XT's heart, kill bosses in a different order, kill boss in a certain amount of time, kill boss while leaving guardians up, pushing a button, etc etc etc). There were two versions of the raid: Regular (10 man), and Heroic (25 man), with special HardMode options on some bosses.
They didn't like the confounded way to activate HardModes, so in ToC they just made 4 versions of the raid; 10 Man, 10 Man Heroic, 25 Man, and 25 Man Heroic. The "heroic" versions of the raid had the HardModes.
In ICC they are doing it differently again. They are going back to just two raid, 10 Man and 25 Man. In order to unlock HardModes you have to kill the Lich King normally. Once you kill the Lich King in a 10 or 25 man, you unlock the ability to do 10 or 25 man HardModes. The HardModes are activated through the drop-down menu (the right click, where you set raid difficulty and loot method) on a PER BOSS BASIS. That means that when you enter 10 man ICC, you get to Marrowgar and can select whether to do HardMode or not. Then you move on to Deathwhisper and can select HardMode or not.
This way you can select which HardModes to work on and skip any HardModes that might be too difficult at the moment.

I just wanna add that in order to enter a hc ToC instance, you needed to have killed anub'arak on the normal version as well. Or your raid leader anyways.
The way I see it, they merged mechanics from both Ulduar and ToC. Cba to expand on that atm, I might edit my post later on to include an explanation.

There are no hard modes in ICC, just like there were no hard modes in ToC. Heroic mode replaced hard modes.
Remember there was no heroic mode for Ulduar? Making sense now?

Curious. Does everyone in the raid have to have already killed the LK in normal to activate a Heroic Mode? or just the Raid leader? Or just 1 person in the raid?

Okay, I must be really tired today, because I still have a question.
What I'm getting is that everyone in your raid needs to have killed the LK in normal to set it to Heroic. However, you added, "regardless of what the rest of your group has done". Which seems to be contradictory...but then again, I could be missing the point.

To be honest, the Sarth/Ulduar way was better. Hard modes fit with the gameplay and were actually interesting. Heroic modes are just a UI change.
