Orc Axe Expertise + 3 JC gems = expertise cap. So trading in my dragons gems I get to upgrade properly to the Marrowgar25 ring and also ditch the T9 gloves I had. Further upgrades to the gloves just make the trade better. EJ also says to gem pure expertise but I don't know why the Marrowgar10 cape isn't used instead.

Because you gain more by gemming expertise and using the BiS Cloak than using an inferior cloak and NOT gemming for expertise.
Example:
http://www.wowhead.com/?item=50764
56 expertise (3 gems)
41 hit
72 agil
122 ap
vs
http://www.wowhead.com/?item=49998
52 crit
60 haste (3 gems)
90 agil
105 ap
Let's say I was wearing Shawl of the Nerubian Silk and wanted to switch to the Shadowvault Slayer's. I now have to change 3 gems (which I'm guessing are +20 haste gems) on my current gear. This is a dead-even trade basically, as I'm trading 56 expertise for 60 haste on the gear, but 60 haste for 60 expertise in gems. However, I am gaining a boatload of crit and a nominal amount of AP. If I'm already hit capped (which you probably should be regardless), then the choice is pretty obvious.
With the current gear, it makes more sense to gem for Expertise rather than choosing items that are quite as well itemized for us (inferior) just because they have expertise on them.

I was thinking more as a BiS gear level. Haste is <> with expertise as gems or on gear, but once we hit the crit cap, hit skyrockets in value. It just confuses me slighly as to why EJ says to try and avoid the crit cap but uses the crit cape over the hit one, and gems the hit rating anyway.
