So i quit the game. The account belongs to my bro now. I have a 70 Epiced out Hunter with maxed gathering professions, And 78 FFB Mage with good enchanting and 400 tailoring. You know what he does? Instead of having 4 70+ toons. He deletes them both...
I went up to him and said, "You're F***in Retarded! You coulda had a D/E'r and a Gatherer!"
He said, "Ehh I wasn't gonna use them anyways."

Why would you post on a WoW forum/database if you have no intention of playing WoW ever again?
And I agree that what your brother did was retarded. Even if he didn't want to play them, there's no reason not to keep them just in case he changes his mind or wants more options... if I were you I'd try to talk him into petitioning a GM to restore the two characters.

Accordingly, you may not sell in-game items or currency for "real" money, or exchange those items or currency for value outside of the Game.

We actually shared the account, playing every other day. So when I stopped playing, the account became his.

That is still not allowed.
Are you both minors? If so, the account should of been set up under the name of an adult. The account holder can only share their account with 1 minor that they are the parent or legal guardian of.
Now, even if you are both minors, but one of the accounts was set up under one of your names, then you still couldn't share the account with each other.
Unless you are the legal guardian of your brother, or he is your legal guardian, then you're not supposed to even know his account log-in information.

Or, this could of been prevented in the first place if they had simply adhered to the Terms of Use and had separate accounts.
