Question regarding Deadly Poison and procs

I was doing some talking with a friend regarding DoTs applied to targets, and we got to the point of the error message many have likely seen before - "A more powerful spell is already active". A common example of this is applying a 5CP rupture (with some proc), and then trying to apply a 4CP rupture.
How does this work with Deadly Poison scaling with regards to the re-applications? Will a re-application of DP after Berserking has procced result in all 5 stacks ticking at the boosted AP? Also, vice versa - will a re-application of DP after Berserking has expired result in all 5 ticking at your base AP?
It's a strange question, and obviously nothing we can do anything about, but I was curious if anyone had an answer.
It's a bug with different ranks from different rogues.
Normal DP applies fine.

If you have 4DP stacks proc during berserking, the 5th one which was procced outside that Berserking proc will make the whole 5 stacks tick as normal, without Berserking. It works the other way round too.
